Nombre de projets relevant de l'intérêt général ont bénéficié du soutien d'un des fonds gérés par la Fondation Rou Baudouin (FRB), voire de la FRB elle-même.

Les douze rapports régionaux de la Fondation Roi Baudouin présentent les projets soutenus et les activités menées en 2018 dans les différentes provinces ou régions du pays.

Si nombre de publications font état de l'émergence du nouveau courant philanthropique qui entend promouvoir l'impact investing, la Belgique compte relativement peu de projets de ce type.
D'où l'intérêt du récent reportage que l'hebdomadaire Trends/Tendances consacre aux Social Impact Bonds.
'Les Social Impact Bonds (SIB) permettent à des investisseurs privés de faire travailler leur argent au bénéfice d'un projet social porté par un prestataire de services à but non lucratif, avec un retour sur investissement si les résultats sont à la hauteur.'
Au départ de cette définition présentée en début d'article, l'hebdomadaire Trends/Tendances du 15 août dernier consacre un reportage particulièrement fouillé à cette nouvelle forme d'investissement social qui se développe lentement, notamment en Belgique.
Les SIB sont une forme d'investissement social relativement complexe, du fait qu'elle nécessite un partenariat entre quatre types de structures: un pouvoir public, un organisme intermédiaire qui s'applique à collecter des capitaux auprès d'investisseurs, les investisseurs privés et un prestataire de service qui met en oeuvre le projet d'intérêt général.
Duo for a job
L'asbl Duo for a job expérimente depuis quelques années un projet d'insertion professionnelle de jeunes issus de pays hors Union européenne, sur base d'un mentorat qui est assuré par des seniors.
Le soutien d'Actiris et de KOIS Invest - une société spécialisée dans l'investissement à impact - a permis de démontrer qu'en fin de période de test le taux d'emploi des jeunes bénéficiaires du mentorat Duo for a job dépassait largement celui d'un groupe de contrôle.
Comme convenu dans le contrat, Actiris a dès lors remboursé les investisseurs et leur a octroyé 4% de taux d'intérêt annuel.
Pareil montage financier sur base de Social Impact Bonds permet ainsi à un pouvoir public de ne subsidier un nouveau projet à finalité sociale qu'après que des investisseurs privés aient pris le risque d'en pré-financer la phase expérimentale.
Le budget de Duo for a job bénéficie du soutien d'autres partenaires, au nombre desquels la Fondation Baillet Latour, Porticus ainsi que la Fondation EPIC. On connaît les exigences de la Fondation Epic, dont l'action philanthropique est également conditionnée par une vérification rigoureuse de l'impact effectif des projets bénéficiaires.
KOIS Invest soutient d'autres initiatives à finalité sociale, tel le projet Neet's (Not in Education, Employment or Training) mis en oeuvre à Anvers avec la collaboration du VDAB, ainsi qu'un humanitarian impact bond en faveur de projets gérés par la Croix-Rouge Internationale.
Limites
Citant Raphaëlle Sebag, déléguée générale de l'Impact Invest Lab (Paris), le reportage de Trends souligne que le financement de projets par des SIB nécessite un difficile travail préalable de concertation entre tous les partenaires concernés.
Autre restriction importante, les projets sociaux bénéficiaires doivent pouvoir être évalués sur base d'indicateurs quantifiables, de manière à ce que la rémunération des investisseurs puisse se justifier sur base de critères irréfutables.
Il serait dès lors illusoire d'espérer que nombre de projets financés par la générosité publique puissent faire appel aux Social Impact Bonds
Les SIB comptent néanmoins nombre de partisans dans notre pays, tel Philippe De Backer (député VLD), ainsi que Grégor Chapelle, directeur général d'Actiris.

"Dit Giftenregister voldoet niet aan een proportionaliteitsanalyse"
Uittreksel van het persbericht (22/4/2019) van de V.E.F. (Vereniging voor Ethiek in de Fondsenwerving) over het geplande giftenregisten van alle giften van en naar het buitenland (wetsvoorstel met referentie 54/3550).
Het wetsvoorstel werd uiteindelijk door het Parlement op de sessie van 24 april niet goedgekeurd.
'Aan het nieuwe ‘Wetboek van vennootschappen en verenigingen’ zouden maatregelen worden toegevoegd “ter voorkoming en bestrijding van vormen van criminaliteit, zoals oplichting, witwassen en financiering van terrorisme”.
Het tweede deel van het wetsvoorstel verplicht verenigingen en stichtingen om een register bij te houden en neer te leggen, van alle giften van en naar het buitenland, vanaf een bepaald minimaal bedrag per vereniging.
Volgens de Vereniging voor Ethiek in de Fondsenwerving voldoet dit Giftenregister niet aan een proportionaliteitsanalyse want het staat buiten verhouding tot het te verwachten resultaat; vervolgens zal het weinig of geen preventief of ontradend effect hebben en tenslotte zelfs potentieel contraproductief zijn.
De leden van de Vereniging voor Ethiek in de Fondsenwerving verzoeken dus de volksvertegenwoordigers om dit wetsvoorstel te verwerpen, alhoewel zij gewonnen zijn voor het eerste luik, dat een veralgemeende transparantie invoert dankzij de neerleggingsplicht voor de jaarrekeningen van verenigingen en stichtingen, ongeacht hun grootte, bij de Balanscentrale van de Nationale Bank van België.'

5/6/2019 - La Commission pour la Vie Privée fonctionne depuis près d’un an sous sa nouvelle dénomination: APD (Autorité de Protection des Données) ou GBA (Gegevensbeschermingsautoriteit).
L'instance dispose depuis peu d'un nouveau Comité de Direction composé de cinq directeurs.
La coordination du secrétariat général est assurée par Monsieur Daniel Stevens, qui était jusqu'il y a peu responsable 'privacy' du bureau d'études Nielssen.
Le premier anniversaire de la mise en application de la réglementation européenne a incité différents médias à proposer un bilan des avancées enregsitrées depuis le 25 mai 2018.
Het Belang van Limburg (25/5/2019) note que 340 plaintes ont été enregistrées par l'APD depuis l'entrée en vigueur de la RGPD.
La plupart d'entre elles concernent des problèmes de caméras de surveillance, de direct markeing ou d'opposition à certains traitements de données.
Plus de 6.000 demandes d'information ont été enregistrées en 2018.
Le quotidien De Tijd (24/04/2019) observe que la structure belge n'a enregistré entre le 25 mai 2018 et fin janvier 2019 que 442 déclarations de pertes de données personnelles, contre 21.000 déclarations enregistrées dans le courant de 2018 aux Pays-Bas.
Le quotidien souligne également que le nombre de personnes nommées au titre de DPO est en croissance exponentielle, mais que les diplômes dont certaines de ces personnes se prévalent ne bénéficient à l'heure actuelle pas encore d'une reconnaissance officielle de l'APD.
Celle-ci semble ne pas souhaiter s'impliquer dans l'immédiat dans une certification de ces diplômes, malgré la demande de divers organismes de formation, tel Data Protection Institute (DPI), la Solvay Business School et Howest (Kortrijk).
Sollicitée par l'hebdomadaire Trends, Nathalie Ragheno, conseillère juridique à la FEB, est d'avis que ces résultats confirment la position attentiste de nombreuses entreprises belges.
L’inaction de l’Autorité de protection des données les a convaincu qu’elles ne risquaient rien.
Les petites structures sont souvent rebutées par les charges administratives énormes imposées par le RGPD. Or elles devraient au minimum faire l'effort de réaliser le régistre des traitements.
Interrogé par De Tijd (24/04/2019) Daniel Stevens estime qu'il est temps que l'APD remplisse ses missions de manière plus proactive: ‘De tijd van sit back and relax is voorbij’.
La Libre Belgique (22/5/2019) consacre un intéressant reportage au processus de mise en conformité mis en oeuvre par IPM, éditeur du quotidien, notamment en matière de protection des données personnelles collectées dans le cadre de leurs sites Internet.
